A Los Angeles Superior Court judge ruled Wednesday that 13-year-old Maceo Robert-Martinez will be permitted to testify in the ongoing legal dispute between his parents, Halle Berry and Olivier Martinez. The decision marks a pivotal moment in a conflict that has intensified since a domestic violence restraining order was requested earlier this month.

Judge Shelley Kaufman’s ruling specifically limits Maceo’s testimony to matters concerning the domestic violence restraining order (DVRO) and does not currently extend to broader modifications of the former couple’s custody arrangement. The ruling follows a request by Olivier Martinez, who argued that his son should have the opportunity to provide his own account of a September 26 incident that triggered the current legal filing.

The conflict centers on an altercation Martinez alleges took place while Maceo was playing a virtual reality video game. In court documents filed on October 1, 2026, Martinez claimed Berry physically abused their son during the argument. Berry has vehemently denied the allegations, characterizing the interaction as “playful roughhousing” rather than an assault. She has also alleged that Martinez is “coaching” the 13-year-old to support his version of events, arguing that testifying would be emotionally damaging to Maceo.

The court’s decision to allow the minor’s testimony comes as both sides prepare for a full hearing on Friday, October 16. That session will determine whether the temporary restraining order currently in place will be made permanent and address potential custody modifications.

The Friday hearing is expected to address the immediate safety concerns and the validity of the abuse claims. While California law allows children of sufficient age and capacity to express their preferences or provide testimony in family court, judges typically exercise discretion to protect the minor’s well-being, often hearing such testimony in private chambers rather than open court.
